SB 26 Behavioral Health Licensing Amendment

SB 26 Behavioral Health Licensing Amendments requires the Rape Recovery Center to inform you of the following information: 

You have the right to request the following information from your provider: 

  • Information on your provider's education, credentials, certifications, registrations, and licenses held by the provider. 

  • Information on your provider’s continuing education

  • Information regarding standards of appropriate care and ethical boundaries

  • A copy of the statutory and administrative rule definitions of unprofessional conduct, or a copy of the generally recognized professional or ethical standards. 

  • Information on the method of treatment recommended, the reasoning supporting the method of treatment, the techniques used, the expected duration of the treatment, if known, and the fee structure

  • Information regarding the individuals who have or have had access to confidential data related to the care of the patient, including evaluations, assessments, diagnoses, prevention or treatment plans, reports, progress notes, discharge summaries, treatment or documentation of treatment, including video recording, live stream, or in-person observations of psychotherapy or other treatment methods.

Filing a Complaint

If you have a concern about your provider you may file a complaint with the Division of Professional Licensing (DOPL). You may file a complaint through an online form (https://dopl.utah.gov/file-a-complaint/). You may also print the form and file the complaint in person.

Please note that relationships with a mental health provider should never include a relationship that is romantic, financially motivated, sexual, or in any other way risks the provider’s judgment or quality of services. These behaviors should be reported to the Division of Professional Licensing.
